KEMENANGAN DIDALAM LAUTAN DARAH

Peristiharan kemenangan bagi pihak penunjuk perasaan yang telah merampas dua lapangan terbangan antara bangsa di Bangkok tempoh hari telah dipersoalan oleh para pemerhati politik tanah air ekoran daripada semenjak bermulanya kumpulan penunjuk perasaan anti kerajaan itu melancarkan gerakan penghabisan untuk menjatuhkan kerajaan pimpinan Somchai Wongsawad, yang dianggap bonika Dr.Thaksin Shinawatra awal bulan Oktober lalu, banyak insiden berdarah berlaku yang mengakibatkan terbunah dan cedera ratusan jiwa para penyokong penunjuk perasaan di Ibu Kota Bangkok, Thailand itu.

Boonleart Changyai, seorang kolumnist tersohor memaparkan tajuk kolumnya dalam akhbar Matichon, sebuah akhbar politik berbahasa thai terbesar dengan perkataan "KEMENANGAN DIDALAM LAUTAN DARAH" ini katanya; kerana pengunduran dua orang Perdana Menteri yang digesa oleh mereka disebabkan keputusan mahkamah yang telah mensabitkan kesalahan bekas pimpinan parti kerajaan itu yang melakukan rasuah semasa berkempen didalam pilihanraya terdahulu. Bukanlah kerana tekanan dari kumpulan penunjuk perasaan yang kian hari makin betambah ganas kelakuannya, malah keganasan itu diikuti dengan pemecatan Patcharawat Wongsuwan dari jawatan Ketua Polis Negara, kerana gagal menyekat Mob masuk ke Lapanangan Terbang Antara Bangsa pada 25 Dec.08

bermula dari 7 Okt. 08 hingga ke tamat perhimpunan tunjuk perasaan pada 3 Dec. semalam penyokong kumpulan penunjuk perasaan menjadi mangsa M79 cukup mengejutkan, 3-4 nyawa terkorban dan hampir 100 jiwa cedera.

Public Health Minister Chalerm Yubamrung has emerged as a possible new prime minister after Somchai Wongsawat was disqualified by the Constitution Court in the dissolution cases against his People Power party (PPP). The court also dissolved the other two parties, Chart Thai and Matchimathipataya, and revoked the political rights of their executives, banning them from politics for five years. As a PPP executive member, Mr Somchai was disqualified and his premiership was automatically terminated. It spelled an end to his 77-day government. Deputy Prime Minister Chaovarat Charnveerakul is acting prime minister until a new prime minister is selected and a new cabinet is formed. Mr Chaovarat and some other cabinet members, including Deputy Prime Minister Olarn Chaipravat, who are not PPP executive members, survived the verdict. A source in the PPP faction controlled by Buri Ram politician Newin Chidchob said Mr Chalerm was a strong favourite to succeed Mr Somchai as premier and is a prudent choice to handle the political situation that appears to be turning against MPs of the dissolved PPP. The source said former deputy prime minister Mingkwan Sangsuwan and Transport Minister Santi Promphat have also been mentioned as likely candidates. Nakhon Phanom MP Phaichitr Srivorakhan, leader of the PPP's Isan Pattana faction, said if the party wants to continue to fight, Mr Chalerm has a combative personality that suits the job perfectly. But in a situation where compromise is needed, Mr Mingkwan is the best choice, he added. Mr Chalerm and Mr Mingkwan are not PPP executives. The surviving PPP members will go to the Puea Thai party already set up to accommodate them after the PPP realised it would be dissolved, according to Puea Thai party spokesman Sakda Noppasit. Nine of the judges on the court bench read out the verdicts at the Administrative Court on Chaeng Wattana road after the Constitution Court was besieged by government supporters. The nine judges were unanimous in dissolving the PPP and Matchimathipataya. The decision to disband Chart Thai was passed eight to one. Nurak Mapraneet was reportedly the judge who felt the party should not be dissolved. In the case of the PPP, the charter court said the Supreme Court's verdict which found former PPP deputy leader Yongyuth Tiyapairat guilty of poll fraud in the election on last Dec 2 was final. The charter court said it had no authority to reverse the Supreme Court's decision. The Election Commission (EC) recommended the dissolution of the PPP following the disqualification of Mr Yongyuth, a list MP. Article 237 of the constitution provides for the dissolution of a party if an executive member is found guilty of violating the election law and the party is found to be complicit in the offence. In the cases against Chart Thai and Matchimathipataya, the court resolved to disband the parties for the same reasons as the PPP disqualification. The EC red-carded Chart Thai deputy secretary-general Monthien Songpracha, a winning candidate in Chai Nat, and Sunthorn Wilawan, deputy leader of Matchimathipataya and a winning candidate in Prachin Buri, for vote-buying in the Dec 23 election. Mr Somchai said in Chiang Mai that now he had been ousted as prime minister, he was an ordinary citizen again. "I have not done anything to benefit myself in the past. I have served the country as best as I possibly could," Mr Somchai said.

พันธมิตรประชาชนเพื่อประชาธิปไตย

เรื่อง ประกาศชัยชนะของประชาชน

ตามที่พันธมิตรประชาชนเพื่อประชาธิปไตยได้จัดชุมนุมใหญ่มาตั้งแต่วันที่ 25 พฤษภาคม 2551 รวม 192 วันนั้น ได้มีวัตถุประสงค์ดังต่อไปนี้

1. คัดค้านการแก้ไขรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550

2. ขับไล่รัฐบาลทรราชฆาตกรหุ่นเชิด เพื่อนำไปสู่การเมืองใหม่ ตลอดระยะเวลาการชุมนุมต่อเนื่องยาวนานที่สุดในประวัติศาสตร์การเมืองไทยถึง 192 วัน เราได้ทำหน้าที่ พิทักษ์ ชาติ ศาสนา พระมหากษัตริย์ และรัฐธรรมนูญ ดังนั้น คุณูปการของพันธมิตรประชาชนเพื่อประชาธิปไตย ที่สำคัญประการหนึ่ง คือการพิทักษ์รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 ได้สำเร็จจนเป็นผลให้ กระบวนการยุติธรรมในประเทศไทยสามารถเดินหน้าพิสูจน์ความผิดของนักการเมืองได้มาจนถึงวันนี้

ผลจากคำวินิจฉัยของตุลาการศาลรัฐธรรมนูญ แสดงให้เห็นว่าการได้อำนาจในการบริหารราชการแผ่นดินที่ ผ่านมานั้นไม่ใช่วิถีทางของประชาธิปไตยตามรัฐธรรมนูญ แต่เป็นการได้มาซึ่งอำนาจด้วยการทุจริตการเลือกตั้ง และเป็นบทพิสูจน์ที่แสดงให้เห็นว่าการชุมนุมของพันธมิตรประชาชนเพื่อประชาธิปไตยนั้นเป็นความถูกต้องชอบ ธรรมเป็นที่ประจักษ์

จากผลคำวินิจฉัยของตุลาการศาลรัฐธรรมนูญนั้นเป็นผลทำให้ช่วงระยะเวลานี้ พันธมิตรประชาชนเพื่อ ประชาธิปไตย บรรลุเงื่อนไขทั้ง 2 ประการคือ

1. ได้รับชัยชนะในการพิทักษ์รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 ได้เป็นผลสำเร็จ จนทำ ให้เกิดการยุบพรรคการเมืองฝ่ายรัฐบาลที่ทุจริตการเลือกตั้งถึง 3 พรรคการเมือง

2. ได้รับชัยชนะในการขับไล่รัฐบาลทรราชฆาตกรหุ่นเชิดชุดนี้ได้เป็นผลสำเร็จ พันธมิตรประชาชนเพื่อประชาธิปไตยจึงขอประกาศการได้รับชัยชนะตามวัตถุประสงค์ในวันที่ 2 ธันวาคม พ.ศ. 2551 เป็น “ชัยชนะของประชาชน”

เมื่อได้รับชัยชนะตามวัตถุประสงค์แล้ว ประกอบกับเป็นช่วงเวลามหามงคลเนื่องในวันเฉลิมพระชนมพรรษา ของพระบาทสมเด็จพระเจ้าอยู่หัว และพันธมิตรประชาชนเพื่อประชาธิปไตยก็ไม่มีความปราถนาที่จะชุมนุมต่อไป โดยไม่จำเป็น

พันธมิตรประชาชนเพื่อประชาชนเพื่อประชาธิปไตยจึงขอประกาศยุติการชุมนุมทั้งที่ทำเนียบรัฐบาล สนาม บินสุวรรณภูมิ และสนามบินดอนเมือง ในวันที่ 3 ธันวาคม พ.ศ. 2551 พันธมิตรประชาชนเพื่อประชาธิปไตยถือว่าในช่วงเวลานี้เป็นสูญญากาศ ไม่มีรัฐบาลบริหารประเทศตามกฎหมาย

จึงขอเรียกร้องให้ฝ่ายใดก็ตามที่จะเข้าสู่อำนาจในการบริหารประเทศ หาทางออกประเทศ อย่าได้สร้าง เงื่อนไขที่จะก่อให้เกิดวิกฤติทางการเมืองอีก ขอให้หยุดยั้งอย่าให้มีนายกรัฐมนตรีและรัฐบาลหุ่นเชิดระบอบทักษิณ ขอให้สะสางความผิดนักการเมืองในระบอบทักษิณ และขอให้ร่วมกับประชาชนสร้างการเมืองใหม่เพื่อปฏิรูปการเมืองอย่างแท้จริง

เราขอประกาศเจตนารมณ์นับแต่นี้ต่อไปว่า

1. หากรัฐบาลหุ่นเชิดของระบอบทักษิณกลับมาอีก หรือมีการแก้ไขรัฐธรรมนูญ หรือกฎหมาย เพื่อฟอกความ ผิดให้กับคนในระบอบทักษิณ เอื้อประโยชน์ให้กับนักการเมือง หรือลดพระราชอำนาจของพระมหากษัตริย์ พันธมิตรประชาชนเพื่อประชาธิปไตยก็จะกลับมาอีก

2. หลังจากนี้ไป รัฐบาลชุดใดๆก็ตามที่เข้ามาบริหารราชการแผ่นดินแต่ไม่มีความจริงใจในการปฏิรูปสู่การ เมืองใหม่โดยร่วมกับประชาชน พันธมิตรประชาชนเพื่อประชาธิปไตยก็จะกลับมาอีกทันทีเช่นกัน เราขอกราบขอบพระคุณพี่น้องประชาชนทุกท่าน ในการมีส่วนร่วมเหตุการณ์ประวัติศาสตร์ในครั้งนี้ และจน กว่าเราจะพบกันอีกเมื่อชาติต้องการ

PARTY DISSOLUTION People Power, Chart Thai and Matchima Thipataya parties disbanded

The Constitution Court on Tuesday ruled to disband three coalition parties, People Power, Chart Thai and Matchima Thipataya, and banned the three's party executives from electoral process for five years. The high court held the three parties for accountability on electoral fraud involving party executives, Yongyuth Tiyapairat of People Power, Monthien Songpracha of Chart Thai and Sunthorn Wilawan of Matchima Thipataya.In the fraud case linked to People Power Party, the high court cited the Yongyuth conviction by the Supreme Court as the ground to penalise the ruling party.For cases linked to Chart Thai and Matchima Thipataya, it invoked the rulings by the Election Commission as the basis to punish the two parties. The nine presiding judges reached unanimous decisions against People Power and Matchima Thipataya parties. And they formed the eight-to-one decision to punish Chart Thai.The high court opined that the punishment by disbandment was mandatory as sanctioned by Article 237 of the Constitution and that it had no leeway to selectively punish the party executives on the individual basis.

ชี้ขาดยุบพลังประชาชน ตัดสิทธิ์กรรมการบริหาร 5ปี

ผู้สื่อข่าวรายงาน วันนี้ (2 ธ.ค.) ว่า เมื่อสักครู่ที่ผ่านมา นายชัช ชลวร ประธานศาลรัฐธรรมนูญ พร้อมคณะตุลาการศาลรัฐธรรมนูญได้ออกนั่งบัลลังก์เพื่ออ่านคำวินิจฉัยคดียุบพรรคพลังประชาชน (พปช.) หลังเสร็จสิ้นการแถลงปิดคดีในช่วงเช้า ผลปรากฏว่า ศาลมีมติเอกฉันท์ให้ยุบพรรคพลังประชาชนเนื่องจากนายยงยุทธ ติยะไพรัช รองหัวหน้าพรรคพลังประชาชน กระทำความผิดตามพระราบัญญัติประกอบรัฐธรรมนูญว่าด้วยการเลือกตั้งสมาชิกสภาผู้แทนราษฎรและการได้มาซึ่งวุฒิสภา พ.ศ. 2550 และรัฐธรรมนูญมาตรา 68 ประกอบด้วยมาตรา 237 วรรค 2 นอกจากนั้น ยังเพิกถอนสิทธิ์ทางการเมืองหัวหน้าพรรคพลังประชาชนและคณะกรรมการบริหารพรรคฯ ซึ่งดำรงตำแหน่งขณะกระทำความผิดเป็นเวลา 5 ปี นับแต่วันที่ศาลมีคำสั่งให้ยุบพรรคตามรัฐธรรมนูญมาตรา 68 วรรค 4 ประกอบด้วย มาตรา 237 วรรค 2

Akhbar harian Arab memetik laporan yang disiarkan menerusi Saudi Press Agency (SPA), bahawa Majlis itu dalam kenyataan berkata Sabtu (29 November) ialah 1 Zulhijjah, dan tiada hari ke 30 dalam Zulkaedah “kerana majlis tidak menerima sebarang laporan anak bulan kelihatan”.
